These Blitz Sales Terms ("Terms") of Bubcycle Pty Ltd ABN: 36 680 821 970 ("we", "us" or "our") govern the purchase of items and services directly offered by Bubcycle. These terms apply specifically to our Bubcycle Blitz Service.
By purchasing items or engaging with our Bubcycle Blitz services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use our Bubcycle Blitz service. You must be at least 18 years old to use our Bubcycle Blitz service. By using this service, you represent and warrant that you meet this age requirement.
These Bubcycle Blitz Sales Terms establish the legal framework for our Bubcycle Blitz service offering, ensuring transparency, fair dealings, and clear consumer expectations.
- DEFINITIONS AND INTERPRETATION
1.1 Definitions In these Terms and Conditions, unless the context otherwise requires: "Bubcycle Blitz Service" means our professional organisation and decluttering service for children's play spaces.
1.2 Interpretation In these Terms and Conditions, unless the context otherwise requires, headings are for convenience only and do not affect interpretation. Words importing the singular include the plural and vice versa, and words importing a gender include all genders. References to a person include an individual, company, partnership, joint venture, association, or corporate or unincorporated body.
- TERMS INCORPORATION These Terms are to be read in conjunction with our Peer-to-Peer Marketplace Terms. Users acknowledge that the Marketplace Terms, including but not limited to provisions relating to liability, warranties, user conduct, and platform use, are fully applicable to these Bubcucle Blitz Sales services.
All terms, conditions, limitations of liability, and user obligations set out in the Marketplace Terms are hereby incorporated into these Bubcycle Blitz Sales Terms by reference and shall apply with full force and effect.

PRICING AND PAYMENT
4.1 Service Fees Fees for our Bubcycle Blitz service are quoted at the time of booking or consultation. Pricing for services will be clearly communicated and may vary based on service complexity and specific requirements.
4.2 Payment Methods We accept payment through methods displayed at checkout. Payments are processed securely through our designated payment systems.
4.3 Booking Confirmation Booking of services requires payment of the specified fee . By completing payment, you confirm your acceptance of these Terms and commitment to the requested service.
4.4 Cancellation and Refunds We reserve the right to establish and modify cancellation and refund policies for our direct services. Any such policies will be communicated at the time of booking.
- SERVICE LIMITATIONS

- BUBCYCLE BLITZ SERVICE
6.1 Video Consultation We will conduct an initial consultation via video, typically lasting 15 minutes. During this consultation, we will assess your space and provide a written quote through a link to the website, detailing the estimated time and service scope.
6.2 Service Commencement Services will commence upon acceptance of the quote, payment of the required fee, and booking of a mutually agreed appointment time.
6.3 Job Complexity The actual time to complete the service may differ from the initial quote. We will seek your agreement before proceeding with additional work, and any extra hours will be charged at the rate specified during the consultation.
6.4 Item Processing Items collected through our services will be evaluated for potential resale, donation, recycling, or responsible disposal.
- LIABILITY AND INDEMNITY
7.1 Service Limitations We provide our direct services on an "as is" basis and make no additional representations or warranties beyond those incorporated from the Marketplace Terms.
7.2 Property Handling We exercise reasonable care when handling your belongings . However, you acknowledge the inherent risks associated with sorting and handling personal items. Our liability for any damage is limited as specified in the incorporated Marketplace Terms.
7.3 User Indemnity You agree to indemnify us against any claims, losses, or expenses arising from: (a) your use of our direct services; (b) breach of these Terms; or (c) violation of any applicable laws or regulations.
- DISPUTE RESOLUTION
8.1 User Responsibility Users are primarily responsible for resolving any disputes arising from direct services directly with us.
8.2 Communication We encourage users to contact our customer service team to address any concerns or disputes related to our direct services.
8.3 Resolution Process We will make reasonable efforts to investigate and resolve disputes in a fair and timely manner, in accordance with the dispute resolution provisions incorporated from the Marketplace Terms.
- GENERAL TERMS

9.2 Force Majeure
We will not be liable for any failure or delay in performing our obligations under these Terms if such failure or delay results from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, fire, flood, earthquake, pandemic, epidemic, government actions, laws or regulations, strikes, lockouts or other industrial disputes, war, terrorism, civil unrest, failure of telecommunications or internet services, or failure of suppliers or subcontractors. If we are affected by a force majeure event, we will use reasonable endeavours to minimise the impact on you and will notify you as soon as reasonably practicable. Our obligations will be suspended for the duration of the force majeure event, and we will resume performance as soon as reasonably practicable after the event ceases.

These Terms are governed by the laws of New South Wales, Australia. Any legal proceedings will be conducted in accordance with New South Wales law and procedure, and you and we submit to the exclusive jurisdiction of the New South Wales courts.
